Terms and Conditions

  1. Definitions

 In these Terms and Conditions, the following words shall have the following meanings:

 – “Agreement” is a reference to these Terms and Conditions, the Privacy Policy, any order form and payment instructions provided to you;

 – “Course” means the classroom based training course or the distance learning training course that you have requested us to provide to you;

 – “Course Fee” means the fee for the relevant Course as specified on our website and in our brochures;

 – “Terms and Conditions” means the terms and conditions of supply set out in this document;

– “you”, “your”, “yours” or “student” are references to you the person who has requested to enrol in one of our classroom based courses;

 – “we”, “us” and “our” are references to Beacon Financial Training Ltd (company registration number 06290920) of Martland Mill Business Park, Mart Lane, Burscough, Lancs, L39 4XR.

 – “Website” is a reference to our Website staging.beaconfinancialtraining.co.uk  on which we offer our Courses.

  1. Course Bookings

2.1       Any contract for the supply of Courses from this Website is between you and Beacon Financial Training Ltd. You agree to take particular care when providing us with your details and warrant that these details are accurate and complete at the time of ordering. You also warrant that the credit or debit card details that you provide is your own credit or debit card and that you have sufficient funds to make the payment.

2.2       In order to purchase one of our Courses you must either telephone us or email us to secure your booking or complete, book and pay directly through our Website. Courses purchased from this Website are intended for your use only and you warrant that any Courses purchased by you are not for resale and that you are acting as principal only and not as agent for another party when receiving the Course.

2.3      We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

2.4      Once we receive your order we will send you a confirmatory email to confirm your booking. If, for whatever reason, your booking is not accepted by us we will notify you of this in writing together with the reasons.

  • Prices and Payments

3.1       All prices listed on the Website are correct at the time of publication however we reserve the right to alter these in the future. We also reserve the right to alter the Courses available for sale on the Website and to discontinue any Course.

3.2       You can pay by bank transfer or debit/credit card. To ensure that shopping online is secure, your debit/credit card details will be encrypted to prevent the possibility of someone being able to read them as they are sent over the internet. Your credit card company may also do security checks to confirm it is you making the order. Payment by bank transfer must be made to our nominated bank account details of which will appear on our invoice.

3.3       Payment by instalments is possible for our course packages at our discretion for individuals only. Please note, any credit agreement you enter into is subject to the Terms and Conditions set out.

3.4      All Course bookings made by you are subject to these Terms and Conditions. Course Fees may be subject to change and we will publish any change in our Course Fees on our website. Once you have received a confirmed booking and paid your booking deposit the Course Fee for your Course will not alter.

3.5      Please note that Course Fees do not include the cost of examination or registration fees that may be charged by an awarding body.

3.6       Full payment of the Course Fee for corporate bookings must be received by us at least 28 calendar days before the Course is due to start.

  1. Classroom Courses
  • Although our class size is normally no more than 16 students we reserve the right to increase the class size and use a larger training room to accommodate additional delegates as and when we consider this to be necessary.
  • Course attendance is your responsibility. Please ensure that you have the correct details of the Course times, dates and venue.

4.3      The tutor shall have full discretion as to the format and structure of the relevant Course.

4.4      A tutor may request the removal of a participant from a class if the tutor is of the view that the participant’s behaviour is unacceptable and not conducive to learning. In these circumstances any refund is entirely at our discretion. For corporate clients, this will be in consultation and agreement with the client.

4.5      Classes are not repeated. It is entirely your responsibility to ensure that you attend all classes, complete your assignments and obtain a copy of all course hand-outs.

4.6       We undertake to you that the Course provided will be performed with reasonable skill and care and in accordance with acceptable industry practice and standards.

4.7       If you decide to withdraw from a Course after it has started you must notify us in writing of your withdrawal to [email protected]  Any refund payable in these circumstances will be entirely at our discretion.

4.8       Ownership of the copyright and all other intellectual property rights in the course material and other documents provided to you vests in us absolutely and you have no right to copy, reproduce, licence, sell, distribute or otherwise deal with this material in any manner whatsoever without our express written consent.

  1. Cancellation and Transferring a Classroom Course

5.1      Once a booking has been made and acknowledged via email, you have the right to cancel or transfer your booking within 28 calendar days of receipt of the booking.

5.2       The above clause does not apply if the course is starting within 28 calendar days of the booking. Therefore, there would be no refund if the course is starting within 28 calendar days.

5.3      Where you cancel or transfer your booking in accordance with 5.1, you will be entitled to a full refund of any payments you have made in respect of the Course(s).

5.4      If cancellation occurs after 28 calendar days following receipt of the booking the client or customer will be liable for the full invoiced amount and no refund.

5.5      If a course date is transferred after 28 calendar days following receipt of the booking, there will be no extra charge for this.

5.6      All cancellation or transfer requests must be received in writing to [email protected]

5.7       In the extremely unlikely event that we are not able to start or continue a Course as scheduled due to illness or unavoidable absence of the tutor, or for any other reason beyond our reasonable control, we will, at your option, either reschedule the Course or offer a full refund of the Course Fee.

Cancellation of a Distance Learning/Home Study/Online Course

 

5.8      Once a booking has been made in relation to a distance learning or home study course or online video course, no refunds whatsoever can be made.

  1. Disclaimer and Limits to our Liability

6.1      We disclaim any and all liability to you for the supply of the Course and our services to the fullest extent permissible under applicable law.

6.2       If we are found liable for any loss or damage to you such liability is limited to the amount you have paid for the Course. We cannot accept any liability for any loss, damage, cost or expense, including any direct or indirect loss such as loss of profits, to you howsoever arising. This limitation of liability does not apply to personal injury or death arising as a direct result of our negligence.

6.3      We have taken all reasonable steps to prevent internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers or those of third parties.

6.4      We shall not be held liable for any failure or delay in performing the Course where such failure arises as a result of any act or omission which is outside our reasonable control such as an act of God or those of third parties.

6.5       We undertake that we will use suitably qualified and skilled tutors to provide the Course to you however we cannot guarantee or warrant to you that the Course is suitable for you or that you will successfully pass an examination following attendance on the Course.

6.6       Participation on the Course is entirely at your own risk and we cannot be held liable for any loss, damage or injury suffered or incurred by you as a result.
